Ukraine's ruling party leads in election: exit polls

KIEV (Reuters) - Ukrainian President Viktor Yanukovich's pro-business ruling party led in a national election on Sunday and seemed likely to keep its majority in parliament, exit polls showed, despite a strong showing by the combined opposition.

Two exit polls issued when a day of voting ended showed Yanukovich's Party of the Regions in the lead with between 28 percent and 30.5 percent of the voting in the part of balloting conducted by party lists.

But the united opposition, which includes the Batkivshchyna (Fatherland) party of Yanukovich's jailed opponent Yulia Tymoshenko, took around 24 percent while the opposition UDAR liberal party of boxing champion Vitaly Klitschko was on around 15 per cent.

There were no immediate available figures for how this would translate into seats in the 450-member single-chamber parliament.

But Prime Minister Mykola Azarov said the ruling party was the clear victor while another senior leadership figure said the final results would show the Regions holding a majority.

"The exit poll data speaks for itself. It is clear the Party of the Regions has won... These elections signal confidence in the President's policies," Azarov told journalists.

But Arseny Yatsenyuk, head of the united opposition in the absence of Tymoshenko, said: "The exit poll results have shown that the people of Ukraine support the opposition and not the government."

Candidates voted in on party lists account for half of the seats while the other 225 seats will be decided by voting in individual constituencies on a first-past-the-post basis - a feature which is assumed to favor the Regions party.

Though the exit polls showed some decline in support for the Yanukovich government which is unpopular because of its tax and pension policies, the figures suggested the Regions might be able to form a majority especially if it was supported by allies such as the communists.

Borys Kolesnikov, a deputy prime minister, went further, saying he foresaw the Regions picking up two thirds of these single-mandate constituencies, handing the Regions a majority.

Victory by the Regions is certain to cement the leadership of Yanukovich who comes up for re-election in 2015 and whose rule has been marked by an accumulation of presidential powers and antagonism with the West over Tymoshenko's imprisonment.

With the West seeing the poll as a test of Ukraine's commitment to democracy, interest will focus on the judgment that international monitors will hand down.

Observers from the OSCE European security and human rights body are due on Monday to give their judgment on how fair and free they perceived the poll to have been.

A positive assessment could improve Yanukovich's image before Ukraine takes over the organization's chair in January.

ISOLATED UKRAINE

The former Soviet republic of 46 million is more isolated internationally than it has been for years. Apart from being at odds with the United States and the European Union over Tymoshenko, Ukraine does not see eye to eye with Russia which has turned a deaf ear to Kiev's calls for cheaper gas.

At home, the government is also blamed for failing to stamp out corruption and has backed off from painful reforms that could secure much-needed IMF lending to shore up its export-driven economy.

But the Regions, which is bankrolled by the country's wealthy industrialists, should have no difficulty in forming a majority with the Communists who also easily passed the 5 per cent barrier needed for parliamentary representation, according to the exit polls.

But it might now face a tougher time in parliament.

Klitschko, the WBC world heavyweight champion, says his UDAR (Punch) party will team up with the opposition led by Yatsenyuk, a former economy minister, to fight corruption, which they say deters entrepreneurial spirit and foreign investment.

He urged voters on Sunday "vote as your heart tells you".

From her jail in Kharkiv in Ukraine's northeast, Tymoshenko last Thursday issued a statement warning that Yanukovich, who comes up for re-election in 2015, would set up a "dictatorship and never again give up power by peaceful means".

Tymoshenko was jailed for seven years last year for abuse of office relating to a 2009 gas deal with Russia which she made when she was prime minister. The Yanukovich government says the agreement saddled Ukraine with an enormous price for gas supplies.

History

  1. June 10, 2005 Corney Investors LLC is formed.
  2. Corney Investor LLC is managed by VSN Properties LLC (?VSN?).
  3. March 31, 2009 VSN resigns and all members agree to Larry Sirhall becoming the manager.

Attempts by Trustee to take governing rights away from existing Manger

On May 26, 2009, David S. Peterson (?Peterson?) sent Corney members a memorandum of action of the class ?A? member of Corney removing the current manager, Sirhall, and appointing the Trustee as the manager of each company.? (Exhibit F1)

Trustee Seizes LLC?s Bank Account

On June 25, 2009 Corney members learn that Obsidian (apparently acting at the instruction of Padrick) seized Corney?s bank account and sent a letter to Corney?s tenant directing him to hereafter make all payments directly to Obsidian.??

These funds are held by the LLC as reserves to pay for the taxes, insurance, maintenance and upkeep of the real property held by the LLC.??

Corney Interested Parties did not approve this distribution of the LLC?s cash to the Trustee in his role as liquidating trustee of debtor?s bankruptcy.? This money belongs to the LLC and the other 10 Interested Parties who are not the debtor.?

Since the Interested Parties are not a debtor in this case, their money should not be used to pay for the claims against the debtor.? More importantly, the Trustee as an assignee of VSN?s interest in Corney had no rights under the operating agreement to take any such actions.

On June 26, 2009 Opera emailed Peterson regarding the violation of the LLC?s operating agreement. (Exhibit F2)? The violations are as follows?

Section?6.1 of the Operating Agreement of Corney provides that a member cannot transfer its membership interest in Corney without the consent of a majority of the members of Corney, and that any such transfer will not entitle the transferee to ?become or to exercise any rights of a Member.?? Section?6.1 provides further that, during a five-year ?Option Period,? the transferee is?not??entitled to any rights as a Member of the LLC,? and will be entitled to receive only the distributions and allocations of Corney profit and loss to which the transferor would be entitled, until such time, if ever, that the option to purchase described in Section?6.1 is exercised or the transferee is admitted as a substitute member.??

Accordingly, Padrick as VSN?s assignee is?not?entitled to vote as a member of Corney and is not entitled to exercise any management rights under the Operating Agreement.? Governing Oregon law is consistent with this result.??See, O.R.S. 63.259?VSN has committed a number of material breaches of its fiduciary duties to the members of Corney, including, without limitation, the rendering of inaccurate and misleading accountings to the Corney members and the misappropriation of Corney funds, to the detriment of the members of Corney, which preclude VSN from acting as manager of Corney or asserting any management rights.? Based upon the foregoing, Corney, acting through Sirhall, believes that VSN has no management rights and, therefore, that Padrick cannot act as the Manager of Corney.

  1. January 1, 2005 Klondike is formed to own and operate a commercial building in downtown Bend.
  2. Initial managers are Studebaker and Larkin.
  3. On January 1, 2009 Larkin resigns as a manager, all members agree to Barb Tyler (?Tyler?) becoming a manager.
  4. On February 10, 2009 a required capital call is made to all members.
  5. By March 11, 2009 Studebaker and Tyler make their capital call requirements.? Stevens, Larkin, Neuman did not make their capital call requirement.

Trustee Ignores Offer.

  1. In accordance with the provisions of Sections?9.3, 9.4 and?9.5 of the Operating Agreement, on April?15, 2009, Windermere, acting on behalf of Ms. Studebaker, sent to Stevens, Larkin, and Neuman an offer to purchase their respective interests in Klondike.??NO RESPONSE.
  2. On April?20, 2009, Klondike?s business attorney sent to the Simson, by overnight mail, a copy of the purchase offer.??NO RESPONSE.
  3. On May 26, 2009, Opera sent an offer (Exhibit F3) to Simson from Studebaker to purchase the building owed by Klondike. Opera communicated to Peterson that the Trustee received the purchase offer about six weeks ago.? He has not bothered to respond to the purchase offer.? In accordance with the provisions of the Operating Agreement, request is hereby made that the Trustee, as the assignee of the defendants? economic interests as members of Klondike, respond[s] to the Purchase Offer as promptly as possible, but in no event later than June 11, 2009.?? Opera tells Counsel that ?it has come to our attention that the Trustee has either ignored or rejected out of hand any and all offers that have been extended to him to purchase limited liability company membership interests of the four principals of the debtor.? This appears to us to be a blatant disregard of the Trustee?s obligations to the debtor?s creditors?The Trustee?s duty to maximize the value of the debtor?s estate for the benefit of the debtor?s creditors, the Trustee should act promptly to consummate a transaction in accordance with the provisions of the Purchase Offer.? Otherwise, given the precarious state of Klondike?s financial affairs, the Trustee will run the very significant risk of losing all value on account of the debtor Members? interests in Klondike.?

Trustee?s Counsel responded by saying the Offer submitted via mail on April 20, 2009 was?LOST/MISPLACED.

In reviewing the detail of Tonkon Torp?s billings, Simson?s time and billings details shows that on April 22, 2009 there was a ?Telephone conference with Mr. Padrick regarding?REDACTED?(.3); review offer to purchase Interests in Klondike Point LLC (.2); conference with Mr. Aman regardingREDACTED?(.2)? (Exhibit F4)? Simson?s time here totals 0.7 of an hour.? Simson?s rate is $450/hour.? Total charge to the estate $315.? Other professionals have charged their time for this as well.? Padrick (.3) at $600/hour is $180 and Aman (.2) at $325 is $65.? Total charge to the estate to lose an offer is approximately?$560?($315 +$180+$65).

Trustee?s response to Studebaker?s offer was to take away governing rights from existing Manager?s.

  1. On June 4, Padrick filed Articles of Amendment/Dissolution with the Oregon State Corporation Division (Exhibit) changing the company from being member managed to the LLC being manager-managed an action requiring consent of 60% of the members of the LLC pursuant to Section 4.2 of the operating agreement..? By reason of the defendants? failure to make required capital contributions, as of April?30, 2009, the defendants? had only 58.07% of the ownership interests in Klondike, and Studebaker and?Tyler had 41.93% of the ownership interests in Klondike.? Padrick signed the document as Manager of the LLC.? As an assignee of Larkin, Stevens, and Neuman interests? in the LLC, Padrick is not entitled to exercise any management rights under the operating agreement unless or until the remaining members vote to admit him as a member (Exhibit F5).? The Oregon State Corporation Division told Studebaker that falsely filing documents with their administration is a?CIVIL MISDEMEANOR.
  2. On June 23, 2009 Aman emailed a response to Opera enclosing ?copies of memoranda of action of the members of both Klondike and Century, removing the current managers of those companies and appointing the Trustee as the manager of each company.? (Exhibit F6)
  3. In this same email, the ?Trustee, acting as manager of both Klondike and Century? notified Opera that he was ?terminated as legal counsel for either company, effective immediately?.
On June 26, 2009, Opera emailed Aman regarding the violation of the LLC?s operating agreement. (Exhibit F7)
  1. Section?8.1 of the Operating Agreement provides that any transfer of a member?s interest in Klondike is ?prohibited,? and that no member may transfer his interest in Klondike.? Section?8.3.1 of the Operating Agreement provides that the transferee of a member?s interest will?not?be admitted as a substitute member?without?the unanimous written consent of the non?transferring members.? Such consent has?not?been obtained by the Trustee, and will?not?be given either by Studebaker or by Tyler.?
  2. Oregon law is clear that the debtor Members? transfer of their interests to the Trustee allows the Trustee to have recourse only to the members? economic interests in Klondike, and that the Trustee does not become, as a result of such transfer, a member in Klondike or obtain any right to participate in the governance of Klondike.?See, O.R.S. 63.259.?   7. On January 1, 2009 Neuman resigns as manager and all members agree to Hull becoming manager.
  8. On or about February 4, 2009, the property was listed for sale thru Fratzke Commercial Real Estate.? Fratzke received offers between $1,000,000 and $2,650,000.? The property was taken off the market because the highest offer was approximately $573,000 SHORT of paying off the debt obligations of the LLC.
  9. On April 20, 2009 Opera sent an offer requesting the Trustee to, essentially, sign off or sign on to making the Shareholders? capital call contributions.
10.? June 15, 2009 Opera emailed settlement communications to Peterson including details of Century?s cash flow difficulties, the current value being short of the current debt obligations, and how there is no value for the foreseeable future for the estate. (Exhibit F3)

CIO Insights: Canadian Residential Real Estate ? The Next Bubble ...

In our increasingly interconnected world, weakness in one market can quickly reverberate throughout the global economy. As events of the past five years have clearly demonstrated, investors must be vigilant for new stresses. Canada has been a relative isle of stability in recent years, and its real estate market has remained robust even after others have collapsed. But therein may lay a problem.

A Bull Market for Canadian Real Estate

In the past decade, low interest rates combined with high demand for housing and investment properties have caused Canadian residential real estate prices to almost double, far outstripping household income. As property values have grown, Canadians have further increased their debt through home equity loans. Canadian household debt relative to disposable income rose to a record this year, exceeding 150%. Recent estimates are that the big six Canadian banks have over CAD$700 billion in Canadian mortgage exposure and another CAD$180 billion in home-equity loan exposure. The Canadian Mortgage and Housing Corporation (CMHC) has insured about CAD$560 billion of the mortgage market which amounts to about a third of Canadian gross domestic product (GDP).1

Is a Correction Coming?

Many fear that Canadian residential real estate prices are due for a correction. Estimates range from a fall of 10-30%. Overbuilding in some cities, slowing income growth, and higher interest rates are triggers that could cause real estate prices to fall. Due to the high level of household debt in Canada, a fall in property values could have a reverse wealth effect in the world?s 10th largest economy. The Bank of Canada has repeatedly warned that interest rates will increase, which will increase costs to highly leveraged borrowers and potentially lead to defaults and foreclosures. If the CMHC lacks sufficient assets to cover these losses, the Canadian taxpayer will have to take up the slack, adding further pressure on the economy.

Fundamental Differences

While this situation is potentially serious, there are fundamental differences between Canada?s real estate market and those that collapsed in the United States, Ireland, and Spain. First, national statistics for Canadian home ownership affordability are skewed by extreme market conditions in the city of Vancouver, British Columbia, which continues to be the least affordable city in Canada. Reports indicate that many new buyers in Vancouver are not highly levered Canadians but Chinese with plenty of cash looking for second homes and investment properties. As high as Vancouver prices have become, they are still very attractive relative to similar properties in Asia. And while affordability has deteriorated in other areas of Canada, nationally it is still below the peaks reached during the Canadian housing bubble of the late 1980s.

Second, starting in 2008, the Canadian government has implemented a series of reforms to cool the housing market, including higher down payments, more stringent loan-to-value requirements, shorter payment periods, and tougher underwriting standards. Recent data shows that these measures are having the desired effect. In addition, because a greater share of mortgages in Canada have variable interest rates and not the long-term fixed rates favored in the United States, the Canadian market is more sensitive to interest rate changes and hence to Central Bank policy. Finally, unlike in many states within the United States, Canadian homeowners cannot simply walk away from their mortgages, making default a far less attractive option.

In summary, the structure of the Canadian real estate market and timely government policies that have already been implemented make a U.S.-style real estate collapse and the attendant stress on financial markets unlikely, though not impossible.

(AP) ? Scientists in Oregon have created embryos with genes from one man and two women, using a provocative technique that could someday be used to prevent babies from inheriting certain rare incurable diseases.

The researchers at Oregon Health & Sciences University said they are not using the embryos to produce children, and it is not clear when or even if this technique will be put to use. But it has already stirred a debate over its risks and ethics in Britain, where scientists did similar work a few years ago.

The British experiments, reported in 2008, led to headlines about the possibility someday of babies with three parents. But that's an overstatement. The DNA from the second woman amounts to less than 1 percent of the embryo's genes, and it isn't the sort that makes a child look like Mom or Dad. The procedure is simply a way of replacing some defective genes that sabotage the normal workings of cells.

The British government is asking for public comment on the technology before it decides whether to allow its use in the future. One concern it cites is whether such DNA alteration could be an early step down a slippery slope toward "designer babies" ? ordering up, say, a petite, blue-eyed girl or tall, dark-haired boy.

Questions have also arisen about the safety of the technique, not only for the baby who results from the egg, but also for the child's descendants.

In June, an influential British bioethics group concluded that the technology would be ethical to use if proven safe and effective. An expert panel in Britain said in 2011 that there was no evidence the technology was unsafe but urged further study.

Laurie Zoloth, a bioethicist at Northwestern University in Evanston, Ill., said in an interview that safety problems might not show up for several generations. She said she hopes the United States will follow Britain's lead in having a wide-ranging discussion of the technology.

While the kind of diseases it seeks to fight can be terrible, "this might not be the best way to address it," Zoloth said.

Over the past few years, scientists have reported that such experiments produced healthy monkeys and that tests in human eggs showed encouraging results. The Oregon scientists reported Wednesday that they have produced about a dozen early human embryos and found the technique is highly effective in replacing DNA.

The genes they want to replace aren't the kind most people think of, which are found in the nucleus of cells and influence traits such as eye color and height. Rather, these genes reside outside the nucleus in energy-producing structures called mitochondria. These genes are passed along only by mothers, not fathers.

About 1 in every 5,000 children inherits a disease caused by defective mitochondrial genes. The defects can cause many rare diseases with a host of symptoms, including strokes, epilepsy, dementia, blindness, deafness, kidney failure and heart disease.

The new technique, if approved someday for routine use, would allow a woman to give birth to a baby who inherits her nucleus DNA but not her mitochondrial DNA. Here's how it would work:

Doctors would need unfertilized eggs from the patient and a healthy donor. They would remove the nucleus DNA from the donor eggs and replace it with nucleus DNA from the patient's eggs. So, they would end up with eggs that have the prospective mother's nucleus DNA, but the donor's healthy mitochondrial DNA.

In a report published online Wednesday by the journal Nature, Shoukhrat Mitalipov and others at OHSU report transplanting nucleus DNA into 64 unfertilized eggs from healthy donors. After fertilization, 13 eggs showed normal development and went on to form early embryos.

The researchers also reported that four monkeys born in 2009 from eggs that had DNA transplants remain healthy, giving some assurance on safety.

Mitalipov said in an interview that the researchers hope to get federal approval to test the procedure in women, but that current restrictions on using federal money on human embryo research stand in the way of such studies.

The research was funded by the university and the Leducq Foundation in Paris.

Dr. Douglass Turnbull of Newcastle University in Britain, whose team has transplanted DNA between eggs using a different technique, called the new research "very important and encouraging" in showing that such transplants could work.

But "clearly, safety is an issue" with either technique if it is applied to humans, he said.

How We Handled the "Death and Dying Talk" - Listen To My Words ...

Death and dying.

Not a typical dinner topic.

Fortunately, we have a relatively healthy family.

But recently, a family member got very ill, very quickly and out of the blue.

And not just any family member:? a Grandmother.

For 21 days, we didn't say anything to the kids about it.

?

But they knew something was amiss.

?

They picked up on the tears.

The frustrations.

The arguments.

The frequent "meetings" that Mom and Dad had to go to.

?

And while many of you may not agree with how we (as parents) handled the situation, we chose to handle it the way we knew would work best for?our kids.

The last thing we wanted was to put them in a tailspin.

Death is not something that is easily understood.

Not by adults.

Not by "typical" children.

So how in the world would a child with special needs get it?

?

We chose to have our conversations out of the range of little ears.

Our "cry sessions" had to become private or when the kids were in school or in bed for the night.

We chose to tells them that "Mom had a meeting" or "Dad was still at work" when one of us went to the hospital to visit.

And it worked....kinda.

For 21 days.

And we found out that there were some behavior issues in school as well.

I am sure we caused it...seeing that we were choosing to withhold information from them.

Because I am sure they knew something was very wrong.

We informed the school of the death of their Grandmother and the schools were very supportive.

So supportive that one of the schools sent this home to help us:

We didn't read it to them page by page.

We let them read it and look at the pictures.

But it wasn't going to take the place of "the talk" that needed to happen.

We chose not to say anything the night before the funeral.

We know from past experiences that bad news or bad days lead to bad nights and no sleep with these two kids.

So on the morning of?the funeral, we had the talk.

It was 6:30am and the little girl was up early sitting in the living room.

She randomly said "Nana is sick."

?

That stopped my husband and I in our tracks.

And now we had to tell her the truth.

The conversation lasted for less than one minute.

Less than a mere 60 seconds.

We planned on telling her the concrete truth in the simplest forms we knew.

We would only answer her "WH-" questions and would not elaborate unless she wanted to know more.

We weren't going to tell her that she passed away three days prior on my sweet little girl's birthday either.

That will be for a later date...years down the road.

We told her Nana wasn't sick anymore.

She looked at us blankly.

She asked if Nana was in the hospital.

We told her that Nana was with Jesus.

She looked at us blankly.

She asked if Nana was OK.

We told her that she was happy with Jesus.

And at that moment, she stopped, looked down at her little hands and then looked at us and said "OK."

OK.

OK?

That's all you have to say?

No questions?

No comments?

Where was the "Why?" "When?" and "Where?" questions?

Just OK.

At the Church, we gathered in the back, talking and hugging family and friends.

Kate stood next to me, and I was on guard to shelter her from any additional information that she didn't ask herself.

As I talked with one family member, she turned and looked at a marble etching of angels.

Then she turned to me, tugged on my shirt-sleeve and said "Nana is with those angels."

The adults stopped and looked at her, looked at each other, and smiled at the innocence of a child.

Why astronauts experience low blood pressure after returning to Earth from space

ScienceDaily (Oct. 25, 2012) ? When astronauts return to Earth, their altitude isn't the only thing that drops -- their blood pressure does too. This condition, known as orthostatic hypotension, occurs in up to half of those astronauts on short-term missions (two weeks or less) and in nearly all astronauts after long-term missions (four to six months). A new research report published online in The FASEB Journal solves the biological mystery of how this happens by showing that low gravity compromises the ability of arteries and veins to constrict normally, inhibiting the proper flow of blood.

Prevention and treatment strategies developed for astronauts may also hold promise for elderly populations on Earth who experience orthostatic hypotension more than any other age group.

"The idea of space exploration has been tantalizing the imagination of humans since our early existence. As a scientist, I have had the opportunity to learn that there are many medical challenges associated with travel in a weightless environment, such as orthostatic hypotension, bone loss and the recently recognized visual impairment that occurs in astronauts," said Michael D. Delp, Ph.D., a researcher involved in the work from the Department of Applied Physiology and Kinesiology, and the Center for Exercise Science at the University of Florida in Gainesville, Florida. "Although I have come to realize that it is unlikely I will ever get to fulfill my childhood dream of flying in space, I take great satisfaction with helping in the discovery of how microgravity alters the human body and how we can minimize these effects, so humans can safely explore the bounds of our universe."

To make this discovery, Delp and colleagues examined arteries and veins from mice housed at Kennedy Space Center in Florida with blood vessels from groups of mice flown on three of the last five space shuttle missions -- STS-131, STS-133 and STS-135. Mice flown on the STS-131 and STS-135 missions were tested immediately after returning to Earth, whereas mice from STS-133 were tested one, five and seven days after landing. Not only did they find that these mice experienced the equivalent of orthostatic hypotension in humans, they also discovered that it takes as many as four days in normal gravity before the condition is reversed.

"There has been considerable interest in sending humans to the moon, asteroids, and Mars," said Gerald Weissmann, M.D., Editor-in-Chief of The FASEB Journal, "but what we're finding is that extended space missions have their own inherent risks above and beyond the obvious. If we ever hope to visit distant worlds for extended periods of time -- or colonize them permanently -- we've got to figure out how to mitigate the effects that low and no gravity has on the body. This report brings us an important step closer to doing just that."

Spears hooked on drugs in '07, ex-pal testifies

LOS ANGELES --?Pop star Britney Spears' former confidante encouraged her to kick her drug habit five years ago, and brought drug-sniffing dogs to her Malibu home and flushed a bag of white powder down the toilet, he testified Tuesday.?

"She had wanted to get clean, but she was struggling with it," the former friend, Sam Lutfi, told jurors in his civil trial in Los Angeles against Spears and her parents.?

"I told her she needed to do it because she was the mother of two young sons... I told her that society wouldn't tolerate a mother who was abusing drugs."?

Lutfi claims that Spears hired him as her manager for several months in 2007 and 2008, after she became estranged from her family and staff in the midst of a personal and professional breakdown.?

He is seeking 15 percent of her earnings from that period, which were believed to be $800,000 to $1 million per month.?

Attorneys representing Spears argue that Lutfi was never the singer's manager.?

Lutfi said he met Spears in a nightclub in spring of 2007, while she was embroiled in a tough child custody battle with ex-husband Kevin Federline and struggling to kick drug addiction.?

"She wasn't working. She said that she had fired everybody," Lutfi said. "She told me that she had fired her agent. She told me that she had fired her manager, her bodyguards, her publicist, as well."?

Spears told him she infamously shaved her head in February 2007 because she was afraid her hair could be tested for drugs and used against her in her child custody battle against Federline, Lutfi testified.?

"Britney was involved in a wicked child custody battle," Lutfi said. "She told me someone had told her that they can scientifically test her hair for a history of drug use, so she shaved it off."?

The trial has torn the veil off Spears' meltdown when she was twice hospitalized, lost custody of her children, and photographs of her shaving her head and swinging an umbrella made international headlines.?

Lutfi is also suing Spears' mother, alleging she libeled him in her 2008 book, "Through the Storm", in which she claimed Lutfi destroyed Britney Spears' telephone lines, may have drugged her food and tried to cut off the singer from her family. He is suing Spears' father for assault.?

Lutfi testified on Tuesday that Spears offered him a job as her manager soon after they met.?

Lutfi, a college dropout who dabbled in the entertainment industry, at first doubted he was qualified to take the position, but Spears kept asking, he testified.?

Finally, he agreed to take the job, but on two conditions: Britney would stop taking drugs and allow him to bring in an agent and a lawyer to make up for his inexperience.?

"She agreed," Lutfi said. "We even shook hands on it."?

Lutfi said he brought the drug-sniffing dogs to her home on June 13, 2007, as one of his first actions as the pop star's manager.?

He also advised her against going on tour that year because he feared she would have easy access to drugs and would miss out on visits with her young sons, Lutfi testified.?

Lutfi said Spears had a drug relapse in September 2007 and called him in October after spending a night in her car. She asked him to move in with her, although their relationship was strictly professional, and never romantic, he said.?

Lutfi told jurors he was never compensated for his work and his out-of-pocket expenses were never repaid.?

Earlier this week, the record label executive who signed Spears when she was 16 testified that he believed Lutfi was a "gofer" who performed only menial tasks for the "Toxic" singer.?

Spears, who has not attended the trial, was placed under her father's conservatorship in 2008, giving him control of her health and finances. Now 30, she has made a comeback with world tours, hit albums and a new job as a judge on TV talent show "The X Factor."

The increasing intensity of the annual Orionid meteor shower will be on full display Saturday night and Sunday morning as most of the US faces a cold, clear, moonless night ? the perfect celestial screen.

Projected clear skies and low moonlight across much of the country Saturday night and Sunday morning will help fans of celestial phenomena witness a peak of whizzing visitors across the sky as part of the annual Orionid meteor shower.

Sky gazers can expect as many as 60 meteors an hour as the earth crashes into icy remnants abandoned by Halley?s Comet when it shot by the planet in 1986. The meteor shower will originate near the orange-glowing Betelgeuse star that makes up the right shoulder of Orion (The Hunter), most easily found by his conspicuous belt of stars.

The objects are boulders of ice and rock breaking into the atmosphere at about 148,000 miles per hour. Most sizzle and burn, creating ?shooting stars? and even ?earthgrazers? that span the sky. Larger chunks may actually explode into fireballs loud enough to hear down here on earth.

(A large chunk of asteroid that entered the atmosphere and exploded just off the coast of northern California on Wednesday, in some cases shaking houses, was likely not part of the Orionids, NASA says.)

According to Weather.com, large sections of the Atlantic, the South, the Midwest, and Coastal West are likely to see crystal clear skies overnight. The moon has just begun to wax, meaning moonlight interference will be low.

Philosophers have long pondered the stars, but the Orionids usually inspire poetics even among the country?s most hardened space scientists. (For others who want to gush or chat, NASA will have its experts on hand starting Saturday night at this link.)

?The Orionid meteor shower isn?t the strongest, but it?s one of the most beautiful showers of the year,? says Bill Cooke, head of NASA?s Meteoroid Environment Office.

Tony Phillips, who blogs at spaceweather.com, explains why in a NASA post.

?The shower is framed by some of the brightest stars and planets in the heavens,? he writes. ?Constellations such as Taurus, Gemini, and Orion provide a glittering backdrop for the display. But that?s not all. This year, Venus and Jupiter have moved into position with Sirius, the Dog Star, to form a bright triangle in the eastern pre-dawn sky. On the morning of Oct 21st, blazing pieces of Halley?s Comet will cut straight through the heart of this celestial triad.?

NASA has a few suggestions for how to optimize the show. The best display is likely to be two hours before sunrise, when Orion will be straight overhead. The meteors will burst from near Betelgeuse, but will spray across the entire sky. And remember: don?t blink.

?Be prepared for speed,? says Mr. Cooke, according to NASA. ?Only the November Leonids are faster.?

For the 24 hours to 23:00 GMT on Friday, the USD weakened marginally against the JPY and closed at 79.32, as existing home sales in the US declined in September.

On the economic front, Japan?s leading index climbed to 93.2 in August, compared to 93.0 in July. Meanwhile, the coincident index was revised down to a reading of 93.5 in August, compared to 93.8 in July. Also, all industry activity rose 0.1% (MoM) in August, following a 0.6% drop in the previous month.

In the Asian session, at GMT0300, the pair is trading at 79.35, with the USD trading 0.04% higher from Friday?s close.

This morning, the Bank of Japan Governor, Masaaki Shirakawa stated that the central bank must be vigilant about the effect of currency moves on the economy, warning that global economic uncertainty remains high.

Data just released indicated that the merchandise trade deficit in Japan narrowed less-than-expected to ?558.6 billion in September compared to a downwardly revised ?755.9 billion deficit reported in the previous month.

The pair is expected to find support at 79.18, and a fall through could take it to the next support level of 79.02. The pair is expected to find its first resistance at 79.47, and a rise through could take it to the next resistance level of 79.60.

The currency pair is trading just above its 20 Hr and 50 Hr moving averages.
